These Terms and Conditions ("Agreement") constitute a binding contract between the user ("You" or "Your") and Mind Body Health Ltd., ("Company," "We," "Our," or "Us") a company registered in the United Kingdom, with its principal place of business at 21 Coleridge Way, Market Harborough, LE16 8GZ. By accessing or using the 30-Day Fertility Transformation program (the "Program"), You agree to comply with and be bound by the terms and conditions set forth herein.
If You do not agree to these Terms and Conditions, You must not access or use the Program. Please read these Terms and Conditions carefully before participating in the Program.
1. Program Description
The 30-Day Fertility Transformation program is designed to offer support for women with infertility issues by providing tools, resources, and guidance aimed at improving the psychological and emotional well-being of participants. The Program is intended solely to assist individuals in managing the psychological aspects of infertility, but it does not offer medical or psychological treatment, diagnosis, or cure for infertility or any related conditions.
2. No Guarantee of Conception
Participation in the Program does not guarantee conception, pregnancy, or any specific reproductive outcome. The Program is designed to provide general guidance, education, and lifestyle recommendations that may support fertility; however, individual results will vary based on numerous factors, including but not limited to medical history, genetics, age, and underlying health conditions. The Program does not constitute medical advice, diagnosis, or treatment, and should not be relied upon as a substitute for consultation with a qualified healthcare provider. Mind Body Health Ltd. makes no express or implied warranties regarding the effectiveness of the Program in achieving pregnancy, and by participating, you acknowledge and accept that no outcome is assured.
3. Not Medical Advice
The content provided in the Program, including but not limited to any written materials, videos, exercises, or other resources, is for educational purposes only. It is not intended to provide medical advice, diagnosis, or treatment.
Mind Body Health Ltd. is not a medical provider, and the Program should not be used as a substitute for professional medical or psychological care. You should consult with a qualified healthcare professional before making any changes to Your health regimen, and in the case of any medical or psychological concerns, particularly those related to infertility, You are advised to seek professional support.
4. Potential for Psychological Distress
While Mind Body Health Ltd. has made reasonable efforts to design the 30-Day Fertility Transformation program in a manner that avoids the inclusion of potentially harmful, distressing, or triggering language or content, Mind Body Health Ltd. acknowledges that it is impossible to foresee or guarantee what may cause psychological distress or trigger an emotional response in any individual.
By participating in the Program, You acknowledge and accept the inherent risk that some of the content or exercises may inadvertently cause psychological distress or trigger a negative emotional response. You agree to take full responsibility for Your participation in the Program and recognize that Mind Body Health Ltd. has no control over individual reactions to the content.
5. Release of Liability
To the fullest extent permitted by law, You hereby waive, release, and discharge Mind Body Health Ltd. and its directors, employees, agents, and affiliates from any and all claims, demands, actions, causes of action, liabilities, losses, damages, or expenses (including legal fees) arising from, or in connection with, any psychological distress, emotional discomfort, or other adverse effects that may result from Your participation in the Program.
This includes but is not limited to any claims based on the nature or content of the Program, whether or not such distress was foreseeable or whether the content of the Program was directly or indirectly related to any personal experiences or past traumas You may have.
6. Assumption of Risk
You acknowledge that You are voluntarily participating in the Program and assume full responsibility for any emotional, psychological, or physical risks that may arise as a result of engaging with the Program's materials and exercises. Mind Body Health Ltd. makes no guarantee or warranty, express or implied, that the Program will result in a positive outcome or meet Your specific psychological needs or expectations.
If You experience significant emotional or psychological distress while participating in the Program, You agree to promptly seek the assistance of a licensed medical or psychological professional, and You agree to discontinue participation in the Program if necessary.
7. Eligibility and Access
The Program is intended solely for individuals who are at least 18 years old. By participating in the Program, You affirm that You meet the eligibility requirements.
You are responsible for ensuring that Your access to and participation in the Program is in compliance with applicable laws, regulations, and policies in Your jurisdiction.
8. Termination and Suspension of Access
Mind Body Health Ltd. reserves the right to suspend or terminate Your access to the Program at any time, without notice, for any violation of these Terms and Conditions or for any other reason, at Our sole discretion.
9. Intellectual Property
All content provided in the Program, including but not limited to text, graphics, videos, and images, is the property of Mind Body Health Ltd. and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content provided in the Program without express written consent from Mind Body Health Ltd..
10. Privacy
Your use of the Program is also governed by Our Privacy Policy, which outlines how we collect, use, and protect Your personal information. Please review the Privacy Policy before using the Program.
11. Indemnification
You agree to indemnify, defend, and hold harmless Mind Body Health Ltd., its affiliates, directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or related to Your participation in the Program, including but not limited to any claims related to psychological distress or emotional discomfort.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Mind Body Health Ltd. shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or in connection with Your participation in the Program, including but not limited to psychological distress, emotional discomfort, or any injury to mental or physical health.
Our total liability to You, whether in contract, tort (including negligence), or otherwise, shall not exceed the amount You paid for access to the Program.
13. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of laws principles. Any disputes arising under or in connection with this Agreement shall be resolved through binding arbitration in the United Kingdom, in accordance with the rules of the Chartered Institute of Arbitrators, 12 Bloomsbury Square, London, WC1A 2LP, England, United Kingdom.
14. Amendments
Mind Body Health Ltd. reserves the right to modify, amend, or update these Terms and Conditions at any time. Any such modifications will be posted on Our website or otherwise communicated to You. Your continued participation in the Program after any such modifications will constitute Your acceptance of the revised Terms and Conditions.
